1. General Information

1.1. These Terms and Conditions govern the contractual relationship between the Customer (hereinafter "Client", "You") and [Ваше Имя / Название вашей компании] (hereinafter "Guide", "We"), registered in Portugal as an independent tour guide / tourism provider [при наличии укажите номер лицензии RNAAT/RRAAT, например: under RNAAT/RRAAT No. XXXX].
1.2. By booking any of our guided tours on Faial Island, the Client fully acknowledges, understands, and accepts these Terms and Conditions.

2. Services & Booking Conditions

2.1. Provided Services. We offer three main types of guided experiences on Faial Island:

  • Half-Day Car Tour

  • Full-Day Car Tour

  • Caldeira Crater Perimeter Hike (7 km)

2.2. Prices. All prices on the website are indicated in Euros (EUR) per person (or per tour, if agreed individually) and include VAT at the rate currently applicable in the Azores Autonomous Region.
2.3. Booking Confirmation. A booking is considered confirmed only after the payment conditions are met:

  • For Day/Half-day tours, a deposit of 30% of the total value is required to secure the reservation.

  • The remaining 70% must be paid on the day of the tour before the activity starts.

  • The Client is responsible for any transaction or bank transfer fees.

3. Cancellations & Refunds

3.1. Client Cancellations:

  • If the Client cancels the tour more than 48 hours prior to the scheduled start time, the deposit is fully refundable (minus payment processing/Stripe fees, if applicable).

  • If the Client cancels within 48 hours of the tour or fails to show up (No-Show), the 30% deposit is non-refundable.

  • Once the tour has commenced, no refunds will be issued for unused services.

3.2. Cancellations by the Guide. We reserve the right to cancel or modify any tour due to force majeure, technical unforeseen events, or safety concerns. In the event of such a cancellation, the Client will be offered:

  • An alternative date/time for the tour (subject to weather and availability).

  • An alternative tour of equal value.

  • A full refund of any amounts paid (minus payment processing/Stripe fees, if applicable).

4. Weather & Safety Conditions

4.1. Weather on the Azores. The weather in the Azores, and specifically around the Caldeira of Faial (900m altitude), can be unpredictable and change rapidly.
4.2. Alterations. We reserve the right to alter the itinerary of both car and hiking tours to ensure the safety and comfort of the participants.
4.3. Caldeira Hike specifics. The Caldeira Perimeter Hike requires favorable atmospheric conditions. If heavy rain, strong winds, or thick fog make the trail unsafe, we will offer to reschedule, switch to a car tour, or issue a full refund. The Guide cannot be held liable for any personal travel or accommodation expenses incurred by the Client due to weather-related cancellations.

5. Client Obligations, Fitness & Health

5.1. Personal Responsibility. The Client is responsible for arriving on time at the designated meeting point. Clients are also personally responsible for carrying valid travel documents (passport, ID, visas) required to travel to the Azores.
5.2. Health & Fitness Declaration. By booking a tour, the Client declares they are in good physical and mental health.

  • The Caldeira Hike (7 km) requires a moderate level of physical fitness, balance, and proper footwear (hiking shoes). It is not recommended for individuals with severe knee/back issues or vertigo (fear of heights).

5.3. Exclusion from Participation. The Guide reserves the right to refuse participation to any Client who:

  • Does not meet the physical requirements specified for the tour.

  • Lacks mandatory gear (e.g., proper closed-toe shoes for the Caldeira hike).

  • Is under the influence of alcohol or drugs.

  • Behaves in a way that puts themselves, the Guide, or other participants at risk. In these cases, no refund will be provided.

6. Insurances & Liability

6.1. Mandatory Insurance. In accordance with Portuguese law, our activities are covered by Personal Accident Insurance and Civil Liability Insurance.

  • Personal Accident Insurance covers treatment expenses and personal damages up to the limits legally established in Portugal for tourist entertainment agents.

  • Civil Liability Insurance guarantees coverage for damages caused during the activity up to the legal limits.

6.2. Personal Belongings. The Guide is not liable for the loss, theft, or damage of personal belongings (cameras, phones, bags, prescription glasses, etc.) during the tours, including inside the tour vehicle or on the hiking trails.
6.3. External Travel Insurance. Clients are highly recommended to purchase comprehensive international travel and medical insurance independently.

7. Image Rights (Media)

7.1. During the tours, the Guide may take photos or record videos for promotional and marketing purposes (website, social media).
7.2. Unless the Client explicitly objects in writing before the tour begins, it is understood that the Client grants the Guide permission to use these materials for marketing, promotional campaigns, or social media updates. All copyrights remain with the Guide.

8. Privacy & Data Protection (GDPR)

8.1. We respect your privacy and process your personal data (name, email, phone number) in strict compliance with the General Data Protection Regulation (GDPR).
8.2. Your personal details are collected solely for booking, billing, and communication purposes, and will never be shared with third parties without your explicit consent. You have the right to access, modify, or request the deletion of your data at any time by contacting us at: [Ваш Email].

9. Complaints & Dispute Resolution

9.1. Feedback. We highly value your feedback. Any complaints or suggestions should be communicated to the Guide during the tour or in writing within 20 days after the tour ends.
9.2. Legal Jurisdiction. These Terms and Conditions are governed by Portuguese Law. Any legal disputes arising from these services that cannot be resolved amicably shall be settled exclusively by the Tribunal Judicial da Comarca da Horta (Faial, Azores).
